1. Account Setup/Email on file

We will setup your Hosting account after receiving the payment from you and screening the hosting order [in case of any fraud]. It is your responsibility to provide us with an active email id of yours. All communications regarding the hosting account and reports on abuse issue [if any] will be mailed to the same mail id. Clients are asked to ensure that their mail-id stays active at all times. Providing inactive mail id’s and/or false contact informations of any kind will lead to termination of your account.

2. Site Content

The site in the web page should be legal and in no case should promote illegal activities. IRC Bots, Proxy Scripts, banner-ad services (similar to rapidshare, photobucket, or commercial banner ad rotation), commercial audio streaming (more than one or two streams), locally hosted chat scripts, Escrow, High-Yield Interest Programs (HYIP) or related sites, Investment sites such as FOREX and EGOLD exchange, Lottery sites, hacker focused sites/archives/programs, pornography sites or sites promoting illegal activities, Brute Force Programs, Copyright Infringement, Trademark Infringement, Copyright Infringement, Trademark Infringement, warez, cracks, Software Serial Numbers, Mail Bombers and Spam Scripts in the web page may lead to termination of your account.

3. Resource and Network Security:

Clients are not permitted to use 25% or more of system resources for longer than 90 seconds. Running software that interfaces with an IRC [Internet Relay Chat] network, Running any bit torrent application, tracker or client, using any file Sharing/peer-to-peer activities, indulging in any gaming servers such as counter-strike half-life, battlefield1942, etc, running cron entries with intervals of less than 15 minutes, Excessive usage of CGI Scripts etc, may lead to the cancellation of the Client’s Account. We may suspend the use of either CGI, PERL, PHP, MySQL, SSI or other scripts if your account is found to be using an unfair amount of system resources. Any user account, which causes damages to network security, may also result in the termination of such account. At least 90% of your web pages (html) must be “Linked” with files (.GIF, .JPEG, etc.) stored in our server. Web sites those are found containing no html documents or a large number of unlinked files are subjected to deletion of files or account cancellation with or without prior notice.

4. Spams

Any user who indulges in unsolicited commercial e-mail, bulk emailing and spam will have their account terminated with or without notice. This provision is not limited to SPAM sent via fax, email, instant messaging or Usenet/newsgroups. Mobile hosters has the right to charge the Client who indulges with unsolicited commercial e-mail with a specific amount towards a clean up fee. The fixing of the Cleaning Fee is solely at the discretion of Mobile Hosters.

5. Payment Details.

Clients are asked to pay upon their annual price at appropriate time, for the services received for hosting their account. It is the responsibility of the client to ensure that their yearly payment towards Hosting is paid before the due date. Late payment will result in the cancellation of your Account. Always maintain the payment confirmation details which is paid to our bank account and the welcome email you received from us, to ensure quicker services.

6. Backup and Data Storage.

We ensure that our Servers functions to its fullest potential at all times. However, the clients are asked to take the backup of all files and data’s stored in our servers. In case of any natural disaster or Server disaster [Rare circumstances], Mobile hosters are not responsible for files and data residing in your account. Please maintain the back up of all your important mails by forwarding to other domain email id or to any reliable source.

7. Confidentiality:

Clients are requested not to disclose their user-id and password to any other person. If in any case, your password is being hacked due to your mistake, then we don’t take any responsibility for such occurrences. If in any case you are asked to provide your mail-id and password to our staff for administrative or any other purpose, ensure that you change the password after the task with our staff is over. In case of forgotten password, Mobile hosters assists in all ways to provide the clients with the recovered password. However, the clients are asked to store the backups of their username and password with them

8. Bandwidth Usage

Clients are allocated a monthly bandwidth based on the hosting package you purchase. If the bandwidth limit exceeds then we reserve the right to suspend your account until the start of next allocation of bandwidth or until the purchase of more bandwidth or upgrading to higher level of packages. The bandwidth, which remains unused in a particular month, can’t be carried over to the next month.

9. Money-back guarantee.

Mobile Hosters servers carries the unconditional 30-day money back guarantee. If any of our clients stay unsatisfied with our services, they will be refunded their hosting charges without any conditions. However, in no case the charges for purchasing the Domain Names will be refunded. The charges paid to the Domain remains applicable for a year and can be transferred to any hosting company. Money-back guarantee is applicable only to those clients who signup with us for the first time. If in case a particular client had an account with us before, cancelled and signed up again, then he will not be eligible for a refund or if a client has opened a second account with us, then such clients are not eligible for a money-back.

10. Price Change

Mobile Hosters reserves the right to change the prices of its hosting packages at any time. However, the change doesn’t apply to our existing clients. They will be charged the same yearly price as before.

11. Indemnification

Customer agrees that it shall defend, indemnify, save and hold Mobile Hosters harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Mobile Hoster, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Mobile Hosters against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Mobile Hoster; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from Mobile Hoster's server.

12. Arbitration

By using any of our services, you agree to binding arbitration. If any disputes or claims arise against our subsidiaries or us, an arbitrator of Mobile Hoster’s choice will handle such disputes. All decisions rendered by that arbitrator will be binding and final. You are also responsible for any and all costs related to such arbitration.

13. Legal Disclosure

Mobile Hosters reserves the right to disclose any subscriber information to law enforcement agencies without prior approval or consent notification to the client. We will extend our full cooperation to the lawful agencies.

14. Change in the TOS.

Mobile Hosters reserves the right to revise its terms and conditions at any time. We will notify you about significant changes in our terms and conditions by sending a notice to the primary email address specified in your Mobile Hosters account. However, the clients are requested to ensure that they remain updated to the Mobile Hosters revised terms and conditions.
